MyDubbo Region Shopping Card

The myDubbo Region shopping card is an EFTPOS-based gift card that works like any other gift card or voucher based system, the only difference is the money can only be spent in Dubbo, Wellington and surrounding villages, at over 130 participating businesses.

Simply visit a Load Up Store to collect a card and decide how much money to load onto it. You can then use the card to purchase goods and services at any participating business. The cards cannot be redeemed outside of the participating store network.

myDubbo Region shopping cards make the perfect gift for that hard-to-buy-for person, and they are a great way to support local business.

EFTPOS Gift Card Conditions of Use (Terms & Conditions)

This Card is issued by Emerchants Payment Solutions Limited ABN 30 131 436 532, AFSL 404131 (‘we/us/our’). In these conditions ‘you’ are the Card purchaser or user. Emerchants Payment Solutions Limited (“EPSL”) is the issuer, distributor and promoter of the Card. If you acquire the Card you will have a contract with us.

1. Using the Card, you agree to be bound by these Terms and Conditions. You must give these conditions to the user of the Card if that is not you. The Card remains our property.

2. The Card is an eftpos prepaid gift card that is activated once funds are loaded onto it. It can be used for purchasing goods and services where eftpos prepaid cards are accepted for electronic transactions. The account type to be chosen at eftpos terminals is “savings”. The card cannot be used at ATMs for online purchases or over the counter at financial institutions. The Card is not a credit card and nor is it linked to a deposit account with us. Please be aware some merchants may choose not to accept eftpos prepaid gift cards.

3. The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees.

4. Cards sold after 31 March 2018 are valid for three (3) years from the date of activation and cannot be used after expiry. At expiry, the remaining available balance will be forfeited. We will not give you any notice before this happens.

5. After the gift card has expired, it is no longer valid and all transactions will be declined. 75% of the unused value may be reloaded to the card if Why Leave Town Promotions (https://www.whyleavetown.com/contact) are contacted within 60 days of the expiry date. Proof of purchase is required. After 60 days unused value will not be refunded and will become the property of Dubbo Regional Council.

6. Unused value of expired cards returned to Dubbo Regional Council will be reinvested into marketing of the myDubbo Region shopping card program.

6. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments. Authorisations may be declined at some merchants (such as gambling merchants or merchants who choose not to accept prepaid cards). We are not liable in any way when an authorisation is declined for any particular transaction regardless of reason.

7. The Card is like cash and may not be replaced if misused, lost, stolen or damaged. You are responsible for all transactions on the Card, except where there has been fraud or negligence by our staff or agents. If you notice any error relating to the Card, you should notify EML Client Relations immediately on 1300 739 889 during business hours or alternatively you can send an email to support@emerchants.com.au.

8. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, or have a complaint you can send an email to support@emerchants.com.au.

9. We may restrict or stop the use of the Card if suspicious activities are noticed.

10. Any refunds on Card transactions are subject to the policy of the specific merchant. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.

11. You are responsible for checking your transaction history online and knowing your available balance. You can view your balance and transaction history at https://sam.emerchants.com.au (free of charge).

12. Information will be disclosed to third parties about the Card, or transactions made with the Card, whenever allowed by law, and also where necessary to operate the Card and process transactions. A full privacy policy can be viewed at http://www.emerchants.com.au/privacy.

13. We reserve the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions can be viewed at www.emerchants.com.au.

1. Information on how to enter and prizes form part of these Terms and Conditions.

2. Participation in this promotion is deemed acceptance of these Terms and Conditions.

3. Entry is open to all Australian residents aged 18 years and over. If you are under 18, you must get approval from your parent/guardian before you enter and if you will be under 18 on the date the prize is awarded, the prize may be awarded to your parent of guardian at the Promoter’s discretion. By approving your participation or by accepting any prize on your behalf, your parent or guardian accepts these terms and conditions.

4. Directors, officers, management and employees (and their immediate families) of the Promoter and any participating companies or Commonwealth, State, Territory or local government agencies where rules or guidelines applicable to such a company or agency prohibit receipt of a prize are ineligible to enter.

5. Entries for owners and employees of Participating Stores:
a) Store owners and staff are only eligible to enter the promotion with purchases made in stores that they do not hold an interest in
b) Employees are not eligible to receive an entry to the promotion from their place of employment.

6. The promotion opens at 9am (AEST) Monday 30 September 2019 and closes at 5pm (AEST) Thursday 7 November 2019 (“Promotional Period”). The draw will take place at a Venue in Wellington NSW 2820 to be confirmed and announced to all participating stores. The winners will be drawn from a barrel of all entered tickets and will be determined at 6pm (AEST) Friday 8 November 2019. The winner will be notified in writing via email and by telephone within seven (7) days of the draw. The winner’s name will be published on http://mydubboregion.com.au/ for 28 days from this date.

7. The competition will run in participating myDubbo Region Shopping Card stores which are displaying #BUYLOCALORBYELOCAL promotional material in Wellington, NSW 2820, Australia.

8. To enter, individuals must, during the Promotional Period, make a qualifying purchase at a participating Wellington store.
a) Individuals receive an entry ticket by the following method:

Qualifying Purchase

i) Make a minimum purchase of $20 from a participating Store (excluding any tobacco or lottery product)
ii) Purchase must be made in participating Stores; phone and online orders are deemed ineligible to enter
iii) Retain your receipt as proof of purchase
iv) Request an entry ticket (subject to stocks remaining in that Store) from a Customer Service Representative of the Store at the time of making your Qualifying Purchase
v) One (1) entry ticket is permitted per transaction that meets the minimum purchase of $20 at a participating Store.
b) Individuals complete the entry ticket including their full name, contact number, email address, postcode, Store where qualifying purchase was made and dollar value of purchase.
c) Individuals submit the entry ticket as instructed via the promotional entry boxes located at participating Stores.

9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

10. Incomplete, indecipherable, or illegible entries will be deemed invalid.

11. A representative from Dubbo Regional Council will draw the winners randomly. The first 10 valid entries drawn randomly from the entries received up to and including 5pm (AEST) Thursday 7 November 2019 of the Promotional Period will win a Prize.

12. There are 10 Prizes to be awarded. A Prize consists One (1) myDubbo Region Shopping Card valued at $500 (including GST) to be redeemed at Participating Wellington Stores. The minimum total prize pool is valued up to $5,000 (including GST)

13. The myDubbo Region Shopping Card is not reloadable and expires three years from the date of loading as per the Terms and Conditions of the administrating Company Why Leave Town Promotions. The Prize must be redeemed in full before 7 November 2022.The Prize is not, nor any component thereof, transferable, exchangeable or redeemable for cash.

14. It is a condition of accepting a Prize, the winner agrees to be interviewed, photographed, filmed at a time and date or supply photographs and comments when redeeming the prize as determined by the Promoter to be used by the Promoter or their agents for a story or feature on this promotion to be developed and pitched to media or featured on the promoter’s website or their social media pages (or any other form of media it deems suitable) without further remuneration or reference to the winner. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.

15. The winner must not engage in any illegal or unsafe behaviour whilst participating in the prize. To the extent allowable by law, the Promoter and its partners exclude any legal liability or responsibility for legal or otherwise incidents or activities engaged in by the winner during participation in the prize.

16. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The components of the Prize may alter for reasons beyond the Promoter’s control.

17. All Prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The Prize is not valid in conjunction with any other offer. The Prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the Prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their Prize.

18. In acceptance of the prize, the Winner acknowledges that they may incur additional costs associated with redeeming the Prize which are the entire responsibility of the winner.

19. In the event that for any reason whatsoever the Winner does not take the Prize at the time stipulated by the Promoter, then the Prize will be forfeited by the Winner and cash will not be awarded in lieu of the Prize.

20. In the event that a Prize, or part of a Prize, is unavailable, the Promoter reserves the right to substitute the Prize or part of the Prize in its discretion with an alternative Prize or part of the Prize to the same and equal recommended retail value and/or specification.

21. The Promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to Prizes).

22. The Promoter is not responsible nor liable for any Prize damaged in transit in the delivery of their Prize.

23. Any cost associated with entering the Promotion or accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

24. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

25. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

26. If your entry is selected as the winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

30. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://dubbo.com.au/privacypolicy In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.
